Child Custody and Support
Child Custody and Child Support are among the most troublesome areas within Family Law. Problems arise in those areas dealing with the legal and physical custody of the child. Custody status can have a significant impact on parent’s rights concerning the general care and well being of the child.
The California Family Court’s policy on Child Custody is to impose the law so as to ensure what is in “the best interest of the child.” The courts seek to make certain that parents and children have continuing and frequent contact with each other. The courts also seek to encourage each parent to share in the rights and responsibilities of caring and raising for the child.
Child Support is each parent’s ongoing general obligation to continue to provide financial care for the child. Child Support is generally determined by several factors such as parent’s income and the amount of time each parent spends with the child. Overall however the court uses one simple question to resolve custody and support issues “What is in the best interest of the child?”.
