Divorce

Sadly, almost half of all marriages end in divorce. It is one of the most emotional, stressful and financially uncertain situations a person can face.

California law has specific requirements to complete the divorce process.  Having a team of attorneys dedicated to following a plan structured to your needs is essential to ensure that the marriage is properly ended, assets and debts are distributed appropriately and your rights are protected.

There are several steps involved in divorce.  Firstly, a Petition for Divorce, is filed.  The petition for divorce must then be answered by the opposing party.  Either party can then file an Order to Show Cause requesting that the Judge make temporary child custody and support orders while the divorce is processed and completed.  Requests for Restraining Orders can also be made.

During the discovery stage of a Divorce the parties are required to exchange documents and information regarding income, expenses, assets and debts.  It is highly beneficial to have an attorney on your side during the discovery phase.

If there are children in the marriage, the couple must attend a Family Court Services Mediation before a court appointed mediator who will then issue a report to the court with any recommendations.  If the issues cannot be resolved during mediation, the matter will proceed to trial before a Family law judge who will make the final determination as to how things will be structured.
